200 Days After the Illegal House Arrest of the Green Leaders, 33 Political Prisoners Demand an End to This Unjust Arrest

September 6th, 2011 [Kaleme] 200 days after the illegal house arrest of the leaders of the Green movement, Mir Hossein Mousavi and Mehdi Karroubi, 33 political prisoners published a statement from inside Evin prison demanding an end to this unjust and illegal house arrest.

The signatories of the statement include prisoners with a variety of political, social and cultural affiliations, including members of the Participation Front, The Islamic Revolution Mojahedin Organization [reformist political group not to be confused with the MKO], Advar Tahkim, The Freedom Movement,  National-Religious groups, journalists, human rights activists and individuals closely associated with Mir Hossein Mousavi.

The complete content of the statement as provided to Kaleme is as follows:

To the honorable nation of Iran,

It has been 200 days since the illegal house arrest of the honorable and dignified leaders of the Green movement, Mir Hossein Mousavi and Mehdi Karroubi, leaders who during the entire course of the movement have stood proud and resilient on the side of the people, refusing to bow to the lawlessness and violation of human rights by the ruling government of Iran.

Our citizens are fully aware that Mousavi and Karroubi who were both established leaders within the regime, are only guilty of defending the people’s vote and protesting against the electoral coup d’etat, a scandal that is even more evident today. These honorable leaders are guilty of having remained loyal to the central slogans of the Islamic Republic, namely “Independence, Freedom & The Islamic Republic”, emphasizing the importance of the implementation of free and fair elections.

The implementation of free and fair elections in 2009 without interference by security forces could have led to the narrowing of the gap between the people and the ruling government, setting the foundation for national sovereignty, political participation and improvement in the country’s affairs and four years of uninterrupted reforms leading to continuity and efficiency within the regime.

The response by the armed ruling government to the legal, peaceful demonstration of a nation protesting against the widespread atrocities and electoral fraud was the suppression of protesting citizens and the subsequent house arrest of Mousavi and Karroubi; a house arrest that many believe is more difficult to endure than normal prison conditions.

High ranking government officials who repeatedly boast about upholding the law have resorted instead to labeling the protests of millions of citizens as a revolt and a sedition, laying the foundation for the suppression of the people. How can they claim to uphold the law and justify the house arrest of Mousavi and Karroubi in the absence of a judicial due process and without issuing a warrant or holding a trial?

Even if this  house arrest and the restrictions associated with it, is considered a temporary detention, under what articles of the penal code were these acts committed? What are the charges against the leaders of the Green movement and who is the judge that has handed down such charges? What is the legal precedence for such a long house arrest? When exactly does the judiciary intend to begin a judicial due process in order to determine the truth and all that went unsaid  regarding what happened during and after the presidential elections?

Mousavi and Karroubi have both repeatedly stated that they are ready and willing to participate in a public trial. What then is the reason for such a long detention without a trial?  Does this type of behavior demonstrate the authority of the regime? If what the authorities continue to state is indeed true and the Green movement has been squelched as a result of the regimes authority, then they have nothing to worry about, rendering the continued illegal arrest of Mousavi, Karroubi and their honorable spouses Zahra Rahnavard and Fatemeh Karroubi meaningless.  Does this act not represent the desperation of a ruling government unwilling to admit to its failure to fulfill the demands of its people?

The fact that all legal precedence and judicial due process was ignored in the case of Mousavi and Karroubi, is a sign of obvious abuse of power and the transformation of the Islamic Republic from a government based on national sovereignty to an authoritarian state that will abuse power, ignoring all laws, religion and morality in order to achieve its own goals.

To the honorable nation of Iran,

The Green movement began in 2009 as a result of our citizens’ demands to hold free and fair elections, an undeniable right of every nation.  The movement sought to uphold the rights of citizens as described in the Constitution, emphasizing the freedom of expression and the right to protest and has paid a heavy price in order to restore the legal rights of our nation. What is strange and ironic is that the ruling government supports each and every movement in the Middle East fighting against dictatorial regimes, advising the government’s of these countries to recognize the rights of their citizens to self sovereignty and yet they will not provide these same rights to their own citizens, behaving in a manner very similar to the rulers of those countries.

Even more unfortunate, when the former president Mohammad Khatami stressed the importance of freedom for political parties, freedom of the press, the release of all political prisoners and holding free and fair elections as the bear minimum requirements for political participation, the totalitarian regime responded in an aggressive and offensive manner, attacking Khatami, demanding to know why conditions were being defined for the regime. The reality is that all undemocratic governments seek to impose unequivocal and undisputed obedience, rather than looking for ways to implement rational solutions that will lead the country to democracy with the least amount of personal costs.

Unfortunately the ruling government rejected even their own statistics with regards to the presidential elections that claimed fourteen million (?!) voted for reformist candidates and rather than recognizing the rights of millions of voters the government chose to engage in the widespread suppression of citizens through a heavy military atmosphere , a tactic that to date has had little to no results , for the Green movement is still alive and dynamic. These gentlemen did not even dare to issue permits for  peaceful protests and were even fearful of allowing funeral services for a renowned national athlete  and well known political figure.*

The behavior of the ruling government in the past two years regardless of the growing concerns by the independent entities within our civil society from the media outlets to political parties and political figures, can only be interpreted as the acts of “governments alienated from their citizens.”

The widespread, illegal and arbitrary arrests and sentences announced a few days prior to the June 15th, 2009 presidential elections, sentences that were issued a few days after the elections and the show trials that ensued, charging many of Mousavi and Karroubi’s supporters, themselves former high ranking members of this regime, is reminiscent of the coup d’etats that took place in previous decades in Latin American countries and the Middle East, including the military coup that took place in Turkey. The house arrest of Mousavi and Karroubi only further demonstrated these similarities.  The bitter irony of these events is that our country led the fight against dictatorships and authoritarian regimes in the region. The recent developments and anti authoritarian movements  in the Middle East that are gradually eradicating the repressive regimes in the region, also faced such a system of governance.

The authorities within the Islamic Republic are fully aware of the democratic wave taking place in the region, a wave that started because of the Green movement in Iran; a wave that  does not understand national borders or boundaries. The experiences in the other countries of the region demonstrates that the repression and suppression of anti-authoritarian movements is not a lasting strategy. It goes without saying that after having paid such a high price, it is difficult for the ruling government to accept that not only were their acts indefensible, but that they also face a serious issue of legitimacy, particularly as it is evident that very few opportunities exist in order to avoid a complete demise and collapse.

In conclusion we a group of political prisoners and signatories of this statement, in addition to condemning the continued illegal house arrest of the leaders of the Green movement, an act that more than anything resembles kidnapping and hostage taking, announce that the only way out of the current crisis facing our country and avoid even higher national consequences is to end the unjust detention of Mousavi and Karroubi and ensure that the minimum requirements as described by Khatami are implemented. The continuation of the policies of the recent years will only lead to the further weakening of the foundations of the regime and its ultimate self destruction and demise.

بیانیه‌ی ۳۳ زندانی سیاسی به مناسبت دویستمین روز حصر رهبران جنبش سبز: به این حصر ظالمانه پایان دهید

چکیده :ما زندانیان سیاسی امضا کننده‌ی این بیانیه، ضمن محکوم کردن بازداشت غیرقانونی رهبران جنبش سبز که بیش از هرچیز به عملیات آدم‌ربایی و گروگان‌گیری شباهت دارد، اعلام می‌داریم راهی که می‌تواند به خروج کشور از بحران فزاینده‌ی فعلی کمک کند و مانع از تحمیل هزینه‌های بیشتر به منافع ملی شود، پایان بخشیدن به حبس ظالمانه‌ی آقایان موسوی و کروبی و اجرای الزامات و شرایط حداقلی است که آقای خاتمی بیان کرده‌اند. بدیهی است در غیر این صورت و با تدوام سیاست‌ها و رویه‌های دو سال اخیر، این بنیان‌های نظام است که هر روز سست و سست‌تر می‌شود و نظام را به نظامی خود ویران‌گر تبدیل می‌کند….

کلمه: ۳۳ زندانی حامی جنبش سبز در زندان اوین به مناسبت دویستمین روز حصر خانگی رهبران جنبش سبز، میرحسین موسوی و مهدی کروبی، بیانیه‌ای را از داخل زندان صادر کرده‌اند.

آنها در این بیانیه، حبس رهبران جنبش سبز را ظالمانه و غیرقانونی توصیف کرده و نوشته‌اند: ما زندانیان سیاسی امضاکننده‌ی این بیانیه ضمن محکوم کردن بازداشت غیرقانونی رهبران جنبش سبز که بیش از هرچیز به عملیات آدم‌ربایی و گروگان‌گیری شباهت دارد، اعلام می‌داریم راهی که می‌تواند به خروج کشور از بحران فزاینده‌ی فعلی کمک کند و مانع از تحمیل هزینه‌های بیشتر به منافع ملی شود، پایان بخشیدن به حبس ظالمانه‌ی آقایان موسوی و کروبی است.

در میان امضا کنندگان این بیانیه، اسامی زندانیانی از طیف‌های مختلف سیاسی، اجتماعی و فرهنگی از جمله جبهه‌ی مشارکت، سازمان مجاهدین انقلاب اسلامی، ادوار تحکیم، نهضت آزادی، نیروهای ملی-مذهبی، روزنامه‌نگاران، فعالان حقوق بشری و نزدیکان مهندس موسوی دیده می‌شود.

ملت بزرگ و شریف ایران

این ایام مصادف است با دویستمین روز حبس خانگی رهبران عزت‌مند و غیرت‌مند جنبش سبز، مهندس میرحسین موسوی و حجت‌الاسلام والمسلمین کروبی، که در طول این جنبش سربلند و مقاوم در کنار مردم باقی ماندند و تسلیم قانون‌شکنی‌ها و حق‌کشی‌های جریان حاکم نشدند.

برای ملت ما به خوبی روشن است که موسوی و کروبی که هردو از بلندپایه‌ترین چهره‌های مدیران این نظام بوده‌اند؛ جرمشان تنها و تنها دفاع از رای مردم و اعتراض به کودتای انتخاباتی بوده که رسوایی آن امروز پیش از گذشته آشکار شده است. گناه آنها این بوده و هست که به شعارهای محوری انقلاب «استقلال، آزادی، جمهوری اسلامی» و تاکید بر انتخابات آزاد وفادار ماندند و خواهان عملی شدن آن بودند.

انتخابات ریاست جمهوری سال ۸۸ در صورت طی روندی سالم و عدم مداخله‌ی نیروهای نظامی و امنیتی می‌توانست فاصله‌ی میان حکومت و مردم را کاهش دهد و زمینه‌ی حاکمیت ملی، مشارکت سیاسی و اصلاح امور را فراهم و پس از یک وقفه‌ی چهار ساله، روند اصلاحات را که برای حفظ، تداوم و کارآمدی نظام ضروری است، احیا کند. ولی متأسفانه آنچه در فرایند انتخابات رخ داد، نه تنها همه‌ی امیدها را نقش بر آب کرد، بلکه نهاد انتخابات در جمهوری اسلامی را در معرض انهدام قرار داد.

پاسخ جریان مسلط در حاکمیت به اعتراض قانونی و مسالمت‌آمیز مردم به تخلفات و فجایع گسترده انتخاباتی، سرکوب همه‌جانبه‌ی شهروندان معترض در دوران پس از انتخابات و حبس خانگی آقایان موسوی و کروبی بوده است؛ حبسی که همگان می‌گویند که تحمل آن به مراتب سخت‌تر و مشقت‌بارتر از تحمل زندان معمولی است.

به راستی مقامات ارشد نظام، که دائم بر طبل قانون‌گرایی می‌کوبند و قانون را فصل‌الخطاب اعلام می‌کنند و با توسل به این شعار، برچسب اغتشاش و فتنه را بر تجمع‌های اعتراضی و مشروع میلیون‌ها شهروند معترض می‌زنند و خود زمینه‌ساز سرکوب خشونت‌آمیز مردم می‌شوند، چگونه بدون طی روند حقوقی و قانونی و انجام هیچ‌گونه محاکمه و صدور حکمی، حبس خانگی آقایان

موسوی و کروبی را توجیه می‌کنند؟

این حبس توأم با محدودیت‌های مضاعف اگر بازداشت موقت است، براساس کدام ماده و بند از قوانین جزایی کشور اعمال می‌شود؟ چه اتهامی و به وسیله‌ی کدام مقام قضایی به آنها تفهیم شده است؟ مستند به کدام مجوز و اختیار قانونی، بازداشتی چنین طولانی‌مدت توجیه‌پذیر است؟ و نهایتا چه زمانی قرار است دستگاه قضایی اقدام به برگزاری دادگاه کند تا در جریان آن حقایق و ناگفته‌های انتخابات برای مردم روشن شود؟

آقایان موسوی و کروبی که بارها آمادگی خود را برای محاکمه علنی اعلام کرده‌اند، پس دلیل این حبس طولانی بدون محاکمه چه می تواند باشد؟ آیا این رفتار نشانه‌ی اقتدار نظام است؟ اگر آنطور است که مسئولین مرتب تکرار می‌کنند، که جنبش سبز با اقتدار جریان حاکم به پایان رسیده و نگرانی دیگری وجود ندارد، پس حبس غیرقانونی و این‌چنین طولانی موسوی و کروبی به همراه همسران آزاده و گرانقدرشان خانم‌ها زهرا رهنورد و فاطمه کروبی چه معنایی می‌تواند داشته باشد؟ آیا این اقدام نشانگر استیصال جریان حاکم و اذعان به عدم موفقیت خود در مقابله با خواسته‌ها و مطالبات مردم نیست؟

واقعیت این است که که نادیده انگاشتن بدیهیات قانونی و قضایی در قبال آقایان موسوی و کروبی، بارزترین دلیل و نشانه‌ی سوء استفاده از قدرت و نیز نماد و علامت بارزی از روند تلخ تبدیل نظام جمهوری اسلامی ِ متضمن حاکمیت ملی به حکومتی خودکامه و خودسر است که برای رسیدن به اهداف و خواسته‌های حود در استفاده از قدرت هیچ محدودیت قانونی و شرعی و عرفی و اخلاقی برای خود نمی‌شناسد

بنیان جنبش سبز مردم ایران که در سال ۸۸ شکل گرفت، بر استیفای حق برخورداری از انتخابات آزاد و سالم بوده و هست که از بدیهی‌ترین حقوق انکار‌ناپذیر هر ملتی است. تلاش این جنبش با اتکا بر حقوق مصرح مردم در قانون اساسی، تاکید بر حق آزادی بیان و آزادی اعتراض است و تاکنون در مبارزه‌ی قانونی خود برای تأمین بخشی از حقوق اساسی ملت، هزینه‌های گزافی را نیز پرداخت کرده است. اما این نکته، عجیب و طنز آمیز است که حاکمیت با هر انگیزه‌ای از جنبش‌های جاری ضد استبدادی در کشورهای خاورمیانه حمایت می‌کند و به دولت‌های این کشورها توصیه می‌کند که حقوق مردم خود را در اعمال حق حاکمیت آنها به رسمیت بشناسد، ولی این حق را برای شهروندان کشور خود قائل نیست و در قبال آنها رفتاری کاملا مشابه زمامداران آن کشورها دارد.

تأسف‌بارتر اینکه وقتی رییس جمهوری سابق، سید محمد خاتمی، بر آزادی احزاب، مطبوعات، زندانیان سیاسی و برگزاری انتخابات آزاد و سالم به عنوان اقتضائات بدیهی و حداقلی مشارکت سیاسی تاکید می‌کنند، جریان تمامیت‌خواه حاکم با ادبیات پرخاش‌گر و زننده‌ی همیشگی خود به وی حمله‌ور می‌شود که چرا برای نظام شروط تعیین کرده‌اند؟

البته این واقعیتی است که هر گروه سلطه‌گر و حاکمیت غیر دمکراتیکی از دیگران جز فرمانبرداری بی‌چون و چرا نمی‌خواهد و راههای منطقی و کم‌هزینه‌ی دمکراتیک شدن و مهار قدرت خودکامه را برنمی‌تابد.

متأسفانه حاکمیت حتی به تبعات عقلانی ادعای خود در خصوص نتایج انتخابات ریاست‌جمهوری و حتی به گفته‌ی خودشان رأی چهارده میلیونی (!؟) کاندیداهای اصلاح طلب نیز پای‌بند نیست و به جای به رسمیت شناختن حق مسالمت‌آمیز میلیون‌ها رای‌دهنده، سرکوب همه‌جانبه و اعمال فضای امنیتی- نظامی را در دستور کار خود قرار داد که هیچ نتیجه‌ای برای آنان به بار نیاورد و جنبش همچنان تا امروز زنده و پویا باقی مانده است، تا جایی که آقایان نه تنها جرأت صدور مجوز راهپیمایی مسالمت‌آمیر معترضان را ندارند، بلکه از برگزاری مراسم تشییع جنازه یا برگزاری مجلس ختم یک ورزشکار ملی یا یک چهره‌ی سیاسی- ملی نیز در هراس‌اند.

آنچه در دو سال اخیر به وضوح در رفتار حاکمیت مشاهده می‌شود، صرف‌نظر از نگرانی فزاینده از کانون‌های مستقل جامعه‌ی مدنی، از مطبوعات گرفته تا احزاب و نهادها و همچنین شخصیت‌های سیاسی، تنها با منطق «دولت‌های جدا از مردم» قابل توجیه است.

بازداشت‌های گسترده غیرقانونی و خودسرانه که احکام آنها چند روز قبل از انتخابات ۲۲ خرداد ۸۸ صادر شد و پس از انتخابات به اجرا گذاشته شد و دادگاههای فرمایشی و محاکمه‌های نمایشی پس از آن، که متهمان آنها حامیان موسوی و کروبی و بسیاری از آنها از مسئولان رده‌بالای قبلی همین نظام بوده‌اند، یادآور کودتاهای دهه‌های گذشته در کشورهای آمریکای لاتین و خاورمیانه از جمله ترکیه توسط نظامیان بود؛ موضوعی که با حبس خانگی موسوی و کروبی این تشابه را هرچه بیشتر نمایان شناخت. اما طنز تلخ این اتفاقات آنجاست که کشور ما که در گذشته سردمدار مبارزه با نظام استبدادی و خودکامه در منطقه بوده است، همزمان با تحولات اخیر که جنبش‌های ضد استبدادی خاورمیانه به تدریج در حال ریشه‌کن کردن نسل حکومت‌های یکه‌سالار و سرکوبگر هستند، چنین شیوه‌ای از حکمرانی را تجربه می‌کند.

مسئولان امروز جمهوری اسلامی به طور یقین به خوبی واقف هستند که امواج دمکراسی‌خواهی در منطقه، که یکی از مبادی قطعی آن وقوع جنبش سبز در ایران است، با ماهیت فرامرزی آن در تدوام خود مرزهای کشور ما را نیز در خواهد نوردید.

تجربه‌ی این کشورها نشان می‌دهد که به‌کارگیری ابزار زور و سرکوب برای مهار جنبش‌های ضداستبدادی عمری ندارد. البته برای جریان حاکم دشوار است که پس از پرداخت هزینه‌های سنگین، بپذیرد که نه تنها دستاورد قابل دفاعی نداشته بلکه به طور جدی درگیر بحران مشرعیت نیر شده و مشهود است که اندک فرصت‌های باقی‌مانده برای آن نیز رو به اضمحلال دارد.

در پایان، ما زندانیان سیاسی امضا کننده‌ی این بیانیه، ضمن محکوم کردن بازداشت غیرقانونی رهبران جنبش سبز که بیش از هرچیز به عملیات آدم‌ربایی و گروگان‌گیری شباهت دارد، اعلام می‌داریم راهی که می‌تواند به خروج کشور از بحران فزاینده‌ی فعلی کمک کند و مانع از تحمیل هزینه‌های بیشتر به منافع ملی شود، پایان بخشیدن به حبس ظالمانه‌ی آقایان موسوی و کروبی و اجرای الزامات و شرایط حداقلی است که آقای خاتمی بیان کرده‌اند. بدیهی است در غیر این صورت و با تدوام سیاست‌ها و رویه‌های دو سال اخیر، این بنیان‌های نظام است که هر روز سست و سست‌تر می‌شود و نظام را به نظامی خود ویران‌گر تبدیل می‌کند. فاعتبروا یا اولی الابصار.
