Fereshteh Halimi, Wife of Mohammad Mostafai Released from Evin Prison

Saturday August 7th, 2010: Summary- Fereshteh Halimi, was released on bail from Evin prison today. Halimi’s brother and father were also released from Evin a few days ago.

Human Rights lawyer Mohammad Mostafai’s wife, brother-in-law and father in law who were arrested as a result of the charges against him have now all been released.

According to reports from IranGreenVoice, Fereshteh and Farhad Hamili were arrested by security forces on the 24th of July, 2010. Their father was arrested and incarcerated a few days later. Fereshteh Halimi, was finally released on bail from Evin prison, today, August 7th, 2010. Halimi’s brother and father were also released from Evin a few days ago.

Mohammad Mostafai, Human Rights lawyer representing a number of prisoners of conscience, left Iran for Turkey where he has sought political asylum. He had previously expressed grave concern for his imprisoned family members.

Mostafai who was summoned to Tehran Prosecutor’s office for questioning on July 24th, 2010, sited the charges against him and the fact that he was banned from leaving the country as reasons for fleeing Iran and seeking political asylum in Turkey.

According to Mostafai, after being summoned to the prosecutors office and responding to the questions by interrogators, he returned to his office only to find police officers and inspectors awaiting his arrival.

Security forces had arrested Fereshteh and Farhad Halimi, Mostafai’s wife and brother-in-law near his office on the same night.

Earlier this week, in a letter addressed to Tehran’s Prosecutor General, Mostafai demanded the release of his wife and brother-in-law.

Mostafai who had taken refuge at the office of the High Commissioner for Human Rights in Turkey was the lawyer of Sakineh Mohammadi Ashtiani, the women who had originally been sentenced to death by stoning, whose fate is currently on hold as a result of the international attention brought to her case.

Mostafai told BBC: “I did not intend to leave Iran. In reality they left me no choice. I was pretty certain that I was going to be arrested and had also heard from individuals within the judiciary that I had been banned from leaving the country. As a result, I was forced to flee the country illegally, taking refuge in Turkey.”

Mostafai has stated that if provided legal guarantees, he will return to Iran.

چکیده : فرشته حلیمی روز شنبه ۱۶ مرداد ۱۳۸۹ (۷ اوت ۲۰۱۰) با قرار کفالت از زندان آزاد شد. برادر و پدر او نیز در روزهای پیش از آن از زندان اوین آزاد شده بودند.

همسر، برادر همسر و پدر همسر محمد مصطفایی، وکیل دادگستری که در پی صدور حکم جلب او بازداشت شده بودند، همگی از زندان آزاد شده اند.

به گزارش ندای سبز آزادی، فرشته و فرهاد حلیمی از روز دوم مرداد در بازداشت بودند و پدر آنها نیز چند روز بعد توسط نیروهای امنیتی دستگیر شد.

فرشته حلیمی روز شنبه ۱۶ مرداد ۱۳۸۹ (۷ اوت ۲۰۱۰) با قرار کفالت از زندان آزاد شد. برادر و پدر او نیز در روزهای پیش از آن از زندان اوین آزاد شده بودند.

محمد مصطفایی، وکیل چند پرونده حقوق بشری که از ایران خارج شده و در ترکیه تقاضای پناهندگی کرده است، پیش از این درباره وضعیت نزدیکانش ابراز نگرانی کرده بود.

آقای مصطفایی، که روز دوم مرداد (۲۴ ژوئیه) برای ارائه توضیحاتی به دادستانی تهران احضار شده بود، صدور حکم جلب و ممنوع الخروج شدن خود را به عنوان دلایل خروجش از ایران و درخواست پناهندگی در ترکیه اعلام کرد.

به گفته آقای مصطفایی، او پس از دریافت احضاریه و پاسخ به سوال های بازجو، مرخص شد ولی وقتی به دفترش مراجعه کرد متوجه حضور پلیس و بازرسی از این محل شد.

نیروهای امنیتی شامگاه همان روز فرشته و فرهاد حلیمی، همسر و برادر همسر آقای مصطفایی را نزدیک محل کار او بازداشت کردند.

آقای مصطفایی پیش تر نیز در نامه ای خطاب به دادستان عمومی و انقلاب تهران، خواستار آزادی همسر و برادر همسرش شده بود.

آقای مصطفایی که به کمیساریای عالی حقوق بشر در ترکیه پناهنده شده است، وکالت سکینه محمدی آشتیانی را به عهده داشت؛ زنی که به اتهام زنای محصنه به سنگسار محکوم شد و با جهانی شدن پرونده اش، فعلا از سنگسار نجات پیدا کرده است.

آقای مصطفایی به بی بی سی گفت: “من تصمیم نداشتم از ایران خارج شوم. در حقیقت مرا مجبور کردند… به دلیل این که احتمال می دادم من را بازداشت کنند و از کسانی که در دستگاه قضایی بودند، شنیدم که ممنوع الخروج شده ام، مجبور شدم به طور غیرقانونی وارد ترکیه شوم.”

او گفت که حاضر است در صورت دریافت تضمین قضایی به ایران برگردد
